Under the supervision of the Central Bank of Congo (BCC) for a period of 180 days since last June, BIAC is still awaiting its dissolution while savers continue to languish in misery because they do not always have Access to their account. The blockage, according to these shareholders, comes from the BCC. To the point that the file remains stagnant at the level of the justice which should render its judgment since the 4 of December last.

This is a matter of great concern to BIAC shareholders, who, like clients, are eagerly demanding the appointment of a liquidator, as required by law, to ensure that the proceedings can proceed as quickly as possible. To believe the shareholders, this approach is a solution to allow savers to recover the money they have placed in the bank. This solution, it is said, will go through the voluntary dissolution and liquidation of the assets of BIAC so that each interested person can take possession of its deposits.

Alas! Until now, the procedure has remained blocked at the level of the BCC which should solve the dissolution yet legal.

For example, in a press release issued on December 29, 2016, BIAC shareholders reminded the general public and debtors of the bank in particular that any repayment of credit to former members of BIAC Provisional Administration Committee during this period shall be considered null and void.

On this basis, the shareholders remain awaiting the appointment by the BCC of a liquidator, who will be entitled to recover the credits granted. In the absence of a liquidator, the debtor would expose himself to pay his debt again because the legal principle is that “who pays badly, pays twice”, they hammered in the statement.

Still in the same direction, one of the lawyers of the shareholders of BIAC approached, denounced certain maneuvers that would be manipulated by the BCC on the Provisional Administration Committee whose mandate ended on December 25, 2016, in accordance with the order Dated November 25, 2016 to review BIAC’s remedial options.

For the advocate, the Chairman of the Provisional Administration Committee is not qualified to hire BIAC. Hence, he insisted, the public and the debtors must not yield to the pressure and especially to stop paying their credits because the mandate of the President of the Provisional Administration Committee has no legal basis . However, it should be noted that the credits reimbursed would normally be used for BIAC savers and not for the operation of a bank in liquidation. As the shareholders’ press release points out, it is therefore up to the BCC to approve the liquidator so that the procedure can follow its course as soon as possible.

Yesterday, Thursday, December 29, Marcel Utembi and his companions began the last chance tour with President Kabila. Before this one-on-one confrontation, they had relied on the persistent divergences with the delegation of the Rally. Has the demon that hides in the details of 5 percent that blocked up to that point been exorcised? The question remains because the bishops have kept the greatest secrecy on this imperious encounter. However, they have sent the curious and others to follow the developments of the plenaries of this Friday 30 December at 10 am and 3 pm, it is reported. The first one will undoubtedly be based on the Agreement and the second could conclude the foundations of the CENCO. Yes, according to Donatien Nshole, the spokesman of this Catholic structure, Accord or not, the National Episcopal Conference of the Congo should end the direct discussions today.

The chimney of the Interdiocesan Center remained virgin during the month of December while nagging discussions were carried out there to find a political compromise on the management of the country after the end of the mandate of President Kabila. Last Saturday, Marcel Utembi declared that there was a 95 per cent consensus and, on the other hand, everything implied that the remaining 5 per cent would be decanted as easily as an Ave Maria could be recited by a seminarian . However, until the day announced as the ratification of the Agreement, namely this Friday, December 30, the certainty of the unilateral signature of this text is not a given. Majority and Opposition reject these days, the responsibility by press and megaphone interposed. They will do the same if there is no Agreement this Friday. Nothing suprising. This is the most common pattern of politics in Congo-Kinshasa. As for the divergences, the last news, the Majority still does not intend to cede on the desired restructuring of the CENI. For the Rally, the post of Prime Minister must come back to him. He still claims the replacement of Samy Badibanga by a coalition member. Other matters of negotiation concern the sharing of posts at the provincial level. According to sources from both camps, the governors of the current provinces should save their heads, but will be forced to deal with the opposition at the provincial government level. There will remain the thorny issue of the destabilization of the political climate put in harm by the condemnation Wednesday of the opponent Franck Diongo. The Head of State is perhaps the only one who can decant the situation on this crucial issue. From where, the bishops visited him to try to save these assizes that they lead with his great blessing. At the end of this exchange, the delegation of the CENCO declared nothing but fixed an appointment to the opinion today at 10 o’clock.

The tenants of communication houses, Cybercafes and even GSM operators, among whom Orange-Tigo, Vodacom, Airtel and Africel, recorded a huge loss of revenue during the 11 days of blocking the Internet and social networks: Facebook , WhatsApp, Imo, Twiter and Instagram at the beginning of December 19th. It has become practically a habit. The government, through the technical body ARPTC (the Post and Telecommunications Regulatory Authority of the Congo), has taken the initiative to cut the Internet and social networks to prevent the population from exchanging Images and videos of the macabre scenes of confrontations that are often seen in spectacle between the forces of the order and the population. The lifting of the ban on the Internet took place on Wednesday 28 December 2016.

Such a measure has produced many adverse economic consequences, especially for Internet service providers, but also other economic operators who use it to exchange financial data with their partners in the context of business through The DRC and abroad.

Judged anti-social and deprived of rights to information, the act was condemned by several non-governmental organizations (NGOs). This Coalition Rights for All, a platform bringing together NGOs, addressed a memo to mobile telephone operators on the Congolese market by comparing access to the Internet with vital human rights, Like the access to drinking water that should not be deprived of anybody.

According to these organizations, “the disruption of access to the Internet has the same negative impact as interrupting the supply of electricity or drinking water to the civilian population, an act condemned in international humanitarian law ”. Despite their call on operators in the telecommunications sector not to endorse this measure of “violation of the right of access to the Internet”, the measure had no effect. Those for whom the call was intended simply gave in to the pressure. The illegality of the injunction was denounced by the same NGO platform. There was a clear desire to disrupt the exchange of information on political protests related to the post-19 December 2016 period.

    Without protection

The population is doubly shaken in its daily life. It is faced with whims of all kinds imposed by the government or the telecom operators themselves. When these mobile operators unilaterally decided to suddenly increase the cost of the Internet, the population was abandoned to its sad fate without anyone being able to plead its case including the government. On the contrary, the latter and the telecom operators were blaming themselves for degeneration.

It is a custom in Kinshasa and elsewhere. During the Christmas and New Year festivities, the population expresses its joy by using firecrackers and fireworks. The merchants, on the other hand, profit from it to make recipes. In short, make good business. This year, they are deprived of these habits. In a statement released on Monday, December 26, 2016, the Governor of the Kinshasa City-Province, André Kimbuta Yango, prohibited the use and sale of firecrackers throughout its jurisdiction. He instructed the bourgmestres of 24 communes to ensure the strict application of this measure. When questioned, some parents, children and merchants are indignant. When they hear them speak, they think that the one they consider to be the solution is still restricting their freedom. Hence, the cries of the heart to Y’André to raise the measure, since it is the only one to whom this power belongs.

The capital of DR Congo will spend the holiday season without the firecrackers. It was following a ban from the Town Hall. Governor André Kimbuta is simply against it. He opposes it every year. In 2016, it strengthened the mechanisms. He extended the powers to the bourgmestres. He instructed them to implement the scheme. The bourgmestre of Kalamu, Jean-Claude Kadima, is already at the front. Speaking on local radio, he said that the doors of the dungeons are open for any recalcitrant child. He also expanded his position by saying “the child who used the firecracker and the one who funded it will all be arrested.” The officials, including the parents, are also targeted in the broad interpretation of Kadima’s statements. On the other hand, while the authorities are ready to implement this measure, parents, children and sellers describe the attitude. Mrs. Charlie, living in the Mont-Fleuri district, is against it. She says it’s a better distraction for kids. Even if they have not eaten or worn, they are occupied by these different games. A child, surprised lighting the firecracker banned by Kimbuta, said that he did not plan many places where we can play. If he wants to be left behind, he must also ask those who manufacture and those who sell not to do so. Moreover, last year too, he had banned. But we used to be. So we will use, there will be nothing, he said. A salesman said: I know it’s forbidden to sell firecrackers. But, if we do, it is because the children are in need. The Governor must really reconsider his decision, because this helps us to sell during this time. Besides, I, as a parent, digest very badly that. Our children are used to playing. Thus, all children remain convinced that the high-summit will solve this problem. In the communication prohibiting the use and sale of firecrackers, André also congratulated the people of Kino for the peaceful attitude observed during the time that people considered the end of the world.

Journalists dispatched to the Inter-diocesan Center to cover the plenary of the Dialogue held under the auspices of the CENCO, returned almost empty-handed in their editorial, Thursday, December 29, 2016. Plenary scheduled for adoption of the recommendations of the Inclusive Agreement n Moreover, was due to divergences in suffering which, it seems, exceeded the extent of the power of the delegates.

These are divergences on the Head of Government, the powers of the Monitoring Committee and the reconstitution of the CENI that persist. In the face of the intransigence on the one hand of the legates of the Presidential Majority with their allies who signed the Agreement of 18 October last and on the other the Opposition embodied by the Rassemblement and the Front pour le Compliance with the Constitution, the mediators of the CENCO (National Episcopal Conference of the Congo) decided to discuss directly, but separately, with President Kabila and opponent Tshisekedi. In the evening, the prelates traveled to the Palais de la Nation to meet the Head of State. Shortly afterwards, they were announced at Limete, in the residence of Etienne Tshisekedi. At first glance, there is no divergence that is really insurmountable. The different parties to the discussions are torn around individuals, no more. As a matter of principle, the choice or appointment of the Prime Minister rests with the Opposition. But the Rassemblement claims its paternity.

While the others, that is, the caciques of the Presidential Majority, want to retain Samy Badibanga in the Prime Minister’s office on behalf of the Opposition party to the 18 October Agreement. Thus they programmed a plenary to the National Assembly for consideration of the State Budget 2017 stopped at some $ 4 billion. In this regard, the Senate has taken a different approach. At the Plenary on Thursday, December 29, the Senators extended the provisional credits granted to the Government for four months. It is an option that could give enough time to the Government of the Republic to prepare and present a realistic state budget. In any case, it will be necessary for the two Houses of Parliament to come to an agreement as to what is best to be done for the proper functioning of the Republic.

How far are they willing to go?

The CENCO, in a progress report, had spoken of 95% progress since the start of direct negotiations, on 8 December 2016, at the Interdiocesan Center. It was given to journalists to learn that the Head of State would remain in office for an additional year, that a consensual management would be instituted during the transitional period. The duration of the transition has been reduced. The presidential and national legislative elections will be organized in December 2017 and not in April 2018 as originally announced. A Strong Monitoring Committee with expanded powers should be established. Who will take orders? The Rally or the Front? At the latest news, the Front led by the MLC wants to take the lead of the Monitoring Committee, because not starting for the Prime Minister. Even if the Agreement were signed, it will remain, however, the problematic of its implementation.

Tryphon Kin-kiey remains loyal to the Head of State, Joseph Kabila. He remains convinced that nothing will happen in Congo without Kabila, or against Kabila. That said, the former Minister of Relations with the Parliament gives his full support to the direct discussions under the aegis of the CENCO, at the request of the President of the Republic. It is the first Joint Political Declaration of the Party for Action (PA) and Kabila Désir (KD), both fighting forces and spearhead of the Presidential majority, after the constitutional deadline of 19 December 2016 and the publication Of the Samy Badibanga Government.

A government team characterized by sociological and political imbalances. A government that did not take into account the vanguardist Kabilist fighting forces and major electoral fiefs. The political offices of the PA and Kabila Désir held a joint meeting, under the leadership of Tryphon Kin-kiey Mulumba, from 27 to 28 December, at the PA’s national headquarters in Kinshasa. The Deputy Secretary General of the PA, Crispin Miyambi, in charge of Political Affairs, read the statement below, which sanctioned the completion of the work.

Did the Cardinal want to torpedo the work of the CENCO? Should we doubt the neutrality of CENCO? What path do we, Christians of Kinshasa, have to follow? That of the gospel which preaches forgiveness and the search for reconciliation in all circumstances, as the current president of CENCO repeatedly repeats? Or must we sharpen the swords according to the revengeful logic preached on December 25 in our churches? Asked Kajepa Molobi, the pro-Majority analyst who comes here, in another form, with his thoughts without mitts, on the message recently issued by Cardinal Laurent Monsengwo, Archbishop of Kinshasa. For him, in the present circumstances, things being what they are, the only way that corresponds to Christian charity is to agree on a reasonable period of preparation for transparent, credible and peaceful elections. This is not the path chosen by those whom the Cardinal visibly supports. A father concerned for the harmonious future of the family, “the bonus pater familias”, does not preach the peace between two antagonistic groups of the same siblings, obviously taking sides for one and condemning the other without the ” Listen to ”, slice Kajepa Molobi, in his free pit repossession, below.

    Will Monsengwo recover Christian charity?

Sunday, December 25, 2016, the Catholic faithful were surprised by the virulence of the words spoken by His Eminence, Cardinal MONSENGWO, on the day when peace should be celebrated.

In a position as inappropriate as tendentious, the former president of the National Sovereign Conference broke into the talks that CENCO is currently organizing and running.

The Congolese Christians were bewildered by a Machiavellian allusion indicating that their President of the Republic, who had peacefully succeeded Mzee Laurent Désiré Kabila, following an agreement between the leaders in office at the time of the assassination, which was Confirmed by all the representatives of the nation in Sun City and elected by universal suffrage in 2006, then reelected in 2011, that this one, despite this journey, would have come to power by arms!

More astonishing still, he who should preach peace did not hesitate to threaten by promising death by the sword.

The place of the church, one might think, is in the middle of the village. Although concealed in a liturgical vocabulary, the message delivered on December 25 in the churches of Kinshasa is not meant to reconcile or unite. It’s a hate message.

In this speech, not all victims deserved the same attention. The police and other peaceful citizens attacked for refusing to participate in the insurrection of December 19 and 20 did not deserve any reference from the head of the Catholic Church in China. No comments were made about those who burned the vehicles of peaceful citizens. No advice has been given to the politicians who strive to dump the streets of the gangs of breakers and killers. Nothing against those who were strutted with Kalashnikov in the streets of Kinshasa, during the demonstrations presented as peaceful by the opposition. Those who attacked the shops and other facilities of others were not entitled to any remark from the prelate.

For the Archbishop of Kinshasa, there are precious deaths that merit mourning and other worthless ones that are treated with indifference. This is particularly the case of policemen burned at point blank range on 19 and 20 December. One might think that there were Catholics among them.

The message of 25 December 2016 of this year is obviously away from the preaching of reconciliation and the peace efforts of Pope Francis.

This homily takes position for that part of the most extremist political class which wants to violate the Constitution, putting an end to democracy, to impose “the special regime” that the Rassemblement expects to establish after street riots.

Moreover, this unavowed political motivation is betrayed by the fact that this text was very quickly edited in a brochure to ensure its wide dissemination.

How can this violent discourse be reconciled with a few biblical verses with the current efforts of the CENCO?

Did the Cardinal want to torpedo the work of the CENCO? Should we doubt the neutrality of CENCO?

What path do we, Christians of Kinshasa, have to follow? That of the gospel which preaches forgiveness and the search for reconciliation in all circumstances, as the current president of CENCO repeatedly repeats? Or must we sharpen the swords according to the revengeful logic preached on December 25 in our churches?

In the present circumstances, things being what they are, the only way that corresponds to Christian charity is to agree on a period.
